Kerala Building Rules for Applying Permit |Renewal of Building Permits and Rules for Floor Area Calculation

Kerala Municipal Building Rules 2020 – Based on the Kerala State environment and landscape Kerala has separate building rules. The rule is called Kerala Municipal Building Rules 1999. It is applicable for all Municipalities in Kerala and it came in to force at once. In the KMBR official website (lsgkerala.gov.in) describes the details of building rules.

Content 

What is Kerala Municipality Building Rules?

In exercise of the powers conferred by sections 381, 382, 387, 398, and 406 read with section 565 of the Kerala Municipality Act, 1994 (20 of 1994) and in supersession of the Kerala Building Rules, 1984 issued in G.O. (Ms.) No. 127/84/LA & SW dated 14th May 1984 and published as S.R.O. No. 486/84 in Kerala Gazette Extraordinary No. 403 dated 15th May 1984, the Government of Kerala hereby prepared Kerala Municipal Building Rules. These rules are applicable for all lands which are proposed to be developed for construction or redeveloped and all developments and buildings existing/propose in any village panchayath areas to which the provision of there rules stand extended. These rules are applicable to the public and private building as mentioned below:

  • Where a building is constructed
  • Where a building is altered
  • Occupancy or use of a building is changed
  • Extension of a building
  • Whole or part of a building is removed

KMBR for Permit Application

For all development or redevelopment of any land or construct/ reconstruct/ make addition/ extension/ alteration to any building every person should obtain a separate building permit for each such work from the Secretary.

Application for Development Permit

Every person has to apply to the Secretary for permission to develop or redevelop any parcel of land along with the site plan, service plan, together with details and specifications as described below:

  • Site plan with the below-given information:
    1. the boundaries of the plot and any contiguous land belonging the owner thereof, including the revenue survey particulars in full.
    2. position of the site in relation to the neighbouring street and its main access.
    3. name of such street, and its width, which shall be the width in between the plot boundaries on the opposite sides.all existing structures in the plot.
    4. all existing streets or foot-paths within the plot.
    5. layout of cul-de-sac, streets, or foot-paths within, adjoining or terminating at the site, existing, proposed to be widened or newly aligned;
    6. proposed plot subdivision, and the areas and uses of each subdivision thereof.
    7. access to each plot subdivision, if any.
    8. layout of any service roads or foot-paths and public parking spaces proposed or existing.
    9. location of any land within the plot that undevelopable such as rocky outcrops, steep terrains, marshes, etc.
    10. area and location of any land within the plot that is not proposed to be developed or redeveloped and reclaimed.
    11. area of any paddy fields and other agricultural lands that are proposed to be reclaimed north direction and predominant wind direction in relation to the site.
    1. topographic contours (with contour interval not less than 1.5 m show the features of the plot clearly) of the site.
    2. any other relevant information of the plot not specially mentioned, but may be required by the Secretary.
  • The service plan shall be drawn to a scale not less than that of the site plan with,
    1. proposed plot sub-division
    2. layout of existing and proposed water supply, electricity, drainage, and sewerage main lines from or to Which connections are proposed to be given with dimensions and specifications.
    3. If the plot is owned by more than one person, the application should be submitted jointly and signed by, all such persons.

Application for Building Permit

To construct a building or make alteration or addition or extension to a building, every person has to apply for the permit to the secretary as per the prescribed format.

  • Site plan with the below-given information.
    1. boundaries of the plot.
    2. position of the plot in relation to the neighbouring street.
    3. Name of the street along which the building is proposed and the width of the street which shall be the width in between the plot boundaries on opposite sides.
    4. all existing buildings standing on, above or below the ground level.
    5. width of the street, if any in the front side or rear of the building.
    6. free passage or way in front of the buildings.
    7. space to be left around the building to secure a free circulation of air and admission of light.
    8. spaces proposed as a garden.
    9. position of external toilets, cattle sheds, stables, wells, and other appurtenant structures.
    10. The north direction in relation to the site.
    11. other particulars as may be required by the Secretary.
  • Building plan with below-given information.
    1. floor plans all floors together with the covered area, accessory building basement floor and use or occupancy of all parts of the buildings.
    2. The exact location of essential services like water closets, sink, and bath.
    3. height of rooms, building and parapet, thickness and spacing of structural members, floor slabs and roof and details of the staircase.
    4. all street elevation dimensions of the projected portions drainage and the slope of the roof.
    5. The direction of the north line relative to the plan of the building.
    6. The total floor area of the building and carpet area of the building.

Building Permit Renewal /Extension of Period of Permits

A development permit or a building permit issued under these rules shall be valid for 5 years from the date of issue. The Secretary shall, on the application submitted within the valid period of the permit, grant extension twice, for further periods of 5 years each and application submitted within one year of the expiry of the permit, grant renewal, once, for a period of 5 years. The fee for an extension of the period of permits shall be ten per cent of the development permit fee or building permit fee as the case may be, in force at the time of granting an extension. The fee for renewal of permits shall be fifty per cent of the development permit fee or building permit fee as the case may be, in force at the time of renewal.

The application for extension or renewal of a development permit or a building permit shall be submitted in the white paper either typed or written in ink, specifying the name and address of the applicant, the stage of development or construction, the number and date of issue of the permit, if already commenced. It shall be affixed with necessary court fee stamp and shall contain the original of the permit and approved plan sought to be extended or renewed. The application for extension or renewal of a building permit or a development permit shall be signed and submitted by the original owner of the permit or his legal heir to whom the site devolves or legally authorized representative and in case the plot concerned has been transferred by the original owner, the transferee or his legally authorized representative.

Kerala Building Rules for Calculation of Floor Area

The total floor area of a building shall be the sum total of floor areas on every floor including the basement. All internal sanitary shafts, air conditioning ducts, lifts shall be included in floor levels and area of ‘Barsati’ or penthouse at terrace floor level shall be included in floor areas. Towers, turrets, domes, etc. of a building projecting above the terrace shall not be included in the floor area at the terrace level.
The ground floor area is calculated at the plinth level excluding the plinth off-sets (if the off-set does not exceed 5 cm.). In cases where the building consists of columns projecting beyond cladding, the floor area shall be taken up to the external face of the cladding. The projections of columns shall not include. In the case of verandahs and balconies with at least one of its sides open (other than parapets) to the exterior or interior open spaces, only 50% of the area shall be taken to calculate the floor area. And open platforms and terraces at ground floor and porches shall not be included in the floor area.
The upper floor area shall be calculated at the relevant floor levels. Architectural bands cornices and others shall not be included in the floor area, vertical sun breakers or box louvres also shall not be included. The area of mezzanine floors and upper floor of seats in an assembly hall, auditorium, etc., shall be fully included in the floor area. The area of the loft shall not be included in it.

Building Measurements and Parts (ബിൽഡിംഗ് അളവുകൾ )

Building Parts Measurements
Mezzanine Floor
  • The floor area shall not exceed one-third area of the main floor or room accommodating the mezzanine floor.
  • The headroom measured from the surface of the floor to any point on the underside of the mezzanine floor shall not be less than 2.2 metres.
Height of Room
  • The height of the room intended for human entry in a building other than residential occupancy and livestock/poultry farm shall not be less than 3 metres.
  • provided that in the case of air-conditioned rooms it shall be not less than 2.4 metres.
Water Closet
  • Every building above 50 square metres of build-up area shall be provided with at least one water close.
Bathroom and Latrine
  • Shall not be less than 1.50 sq.m. with either side not less than 1.1m.
  • The carpet area of a latrine shall not be less than 1.10 square metres with one side not less than 1.0 metre.
  • Bathroom and Latrine shall not less than 2.2 square meters with one side not less than 1.1. metres.
  • Hight of latrine/ bathroom shall not less than 2.20 metres.
Staircase
  • Minimum width of the stair – 120 centimetres
  • Minimum width of tread – 30 cms
  • Maximum height of riser – 15cms
  • Minimum height of handrail – 90cms.
  • Any building having more than three floors including basement floor(s) shall have at least two staircases, one of which may be a fire escape staircase
  • Escalators can be provided instead of staircases. The width of such escalators shall not be less than one metre
Fire escape staircase
  • Width of fire escape staircase shall be not less than one metre
  • Tread shall not be less than 25 centimetres
  • Riser shall not exceed 19 centimetres and the number of risers shall not exceed 16 per flight of stairs
  • Height of handrail of a fire escape staircase shall not be less than 100 centimetres and not more than 120 centimetres.
  • The spacing between the balustrades should be less than 15 centimetres.
  • The use of spiral staircase shall be limited to buildings up to 10 metres in height. Spiral staircase shall not be less than 150 centimetres in diameter and shall be designed to give adequate headroom.
  • Fire escape stairs shall have straight flight for building exceeding 10 metres height
Ramps
  • Stairways shall be laid with a slope not exceeding 1 in 10.
Travel Distance to the emergency staircase
  • It shall be located in such a way that the travel distance on each floor shall not exceed 30 metres for every occupant.
  • An emergency exists may be either vertical or horizontal.
  • Lifts and escalators shall not be considered as emergency exits.
Exit Width
  • Unit of exit width used to measure the capacity of any exit shall be 50 cms.
  • A clear width of 25 cms.
Doorways
  • Exit doorway shall be less than 75 cms in the case of residential and 1.2 metres in the case of all other occupancies.
Corridor, Verandahs and Passageways
  • Width of any corridor, verandah or passageway in any building shall be not less than 1.0 metre at any point
Spiral Stair fire escape
  • spiral staircase shall be not less than 150 cm. in diameter and shall be designed to give adequate headroom.
Lift
  • buildings exceeding 3 storeys in the case of group C Hospital/medical occupancy and four storeys in the case of other occupancies shall have at least one lift.
  • Additional lift shall be provided at the rate of one lift for every 2500 sq. metre of the total built-up area or part thereof (except parking area provided inside the building) in excess
    of the first 4000 square metres

Every owner shall, on completion of the development redevelopment of land or
construction or reconstruction or addition or alteration of buildings, as per the permit
issued to him, submit a completion certificate certified and signed by him, to the
Secretary

✅ How to apply for Building Permit in Kerala?
✔️Applying for a building permit in Kerala is a simple process. Submit a permit application form to the respective local self-government (Panchayath Secretary) with all required documents like

  • Possession certificate 
  • Latest paid land tax receipts
  • Photocopy of the “Aadharam” or Title Deed
  • 3 copies of the Sketch or Sanction drawing

✅ What is the minimum distance between the road and the building?
✔️The minimum distance between the central line of a street and any building (other than a compound wall or fence or outdoor display structure) shall be 4.50 metres and the minimum distance between the street boundary and building shall be 2 metres for buildings up to 7 metres in height, in roads other than National Highway, State Highway, District Roads and roads notified by  Panchayat; and it shall be 3 metres.
